Effects of this Year’s Tougher Traffic School Laws

The new stricter traffic school laws that went into effect earlier this year mean that those ticketed by a police officer can no longer technically obtain a dismissal through traffic school. 

That’s right, instead of the courts dismissing a violation upon proof of traffic school completion, which allowed your record to be cleared of that violation, now the violation you are cited for WILL go on a record that BOTH the courts and Department of Motor Vehicles  can view (this record is supposed to be kept confidential though from Insurance Companies!).  Some effects of this:

  • ·         DMV now has a clear picture of your actual driving history whereas before they did not because a traffic school completion resulted in a dismissal and the violation cleared  from a driving record
  • ·         Judges no longer have discretion to allow you to attend a 12 hour traffic school program for repeat offenders
  • ·         The second ticket you get within 18 months will result in points being added to your license (depending on the number of points the offense you committed carries) and insurance company is notified
  • ·         Since the DMV uses a point system to track violations now if a driver gets a second ticket within18 months their only choice really is to try and fight it in order to avoid accumulating too many points
  • ·         With more people not being able to take traffic school , more people have to contest their tickets with the court, the end result being an increase in the number of trials and added burden on the already limited court staff time
