If you receive instructions from your courthouse to pay the ticket in order to fight it, it is considered posting bail. It’s legal for the court to require you to post bail when you plead not guilty, in fact it’s required by law, although there are limited circumstances under which a judge may waive the requirement to post bail. Bail secures your compliance with court orders because if you miss a deadline your bail is forfeited.

The good news, the law also spells out exactly when the court must refund your deposit of bail to you “within 30 days of a cancellation, dismissal, or finding or not guilty of the offense charged.” If the court fails to refund your bail within 30 days, don’t get too upset, you may profit.
